Terms of Use
Effective September 2, 2026. These Terms govern chericohenpilates.com and the native account, consultation, client, support, and commerce features that link to them.
By using the site, you agree to these Terms. When a transaction, form, waiver, program, or service asks for a separate acceptance or signature, that separate document also applies. If an offer-specific term conflicts with these general Terms for that offer, the more specific accepted term controls. The Privacy Policy explains information practices and is incorporated by reference.
Operator and contact
Cheri Cohen Pilates operates the site. Contact hello@chericohenpilates.com with questions. The site and support channels are not emergency services.
Eligibility, accounts, and authority
- Provide accurate, current information and keep account credentials, verification codes, and devices secure. Tell us promptly about suspected unauthorized access.
- Use only your own account unless the platform expressly recognizes an authorized parent, guardian, payer, participant, instructor, or other representative relationship.
- Do not create an account for a child under 13 or submit a minor's information without first contacting us and having lawful parent or guardian authority.
- You are responsible for actions taken through your account until you report compromise, subject to applicable law and our security review.
Information, Pilates, and health limitations
Website content, path suggestions, classes, education, and communications are general informational and movement-related services. They are not medical advice, diagnosis, treatment, physical therapy, or emergency care and do not guarantee a particular health, fitness, educational, business, certification, or financial result. Consult an appropriate licensed professional about a medical condition or whether activity is appropriate for you. Stop activity and seek appropriate help if you experience concerning symptoms.
Participation may require a separately accepted Client Agreement, Liability Waiver and Assumption of Risk, secure screening, provider clearance, or service-specific instructions. These Terms do not replace those documents. Do not submit health details through public forms, ordinary email, support, or SMS.
Inquiries, waitlists, and consultations
Submitting a contact form, joining a waitlist, requesting a consultation, creating an account, or receiving an automated acknowledgment does not create a reservation, guarantee acceptance or availability, or establish a paid client relationship. A booking or service relationship begins only when Cheri Cohen Pilates provides the required confirmation and any required documents, eligibility, payment, or other conditions are satisfied.
Services and third-party group classes
The native platform offers private Pilates and consultations and may later offer other specifically published services. Pilates instructor education is Coming Soon and is not currently available for purchase, application, or enrollment. Availability, instructor, location, schedule, capacity, prerequisites, access period, and delivery method may change before confirmation. Material offer terms will be displayed before acceptance or purchase.
Group-class links may send you to Tides Pilates or another external provider. That provider controls its schedule, prices, availability, booking, payment, cancellation, privacy, and customer service. Opening a link does not create a native Cheri Cohen Pilates booking or guarantee the third party's offering.
Bookings, changes, and cancellations
A paid appointment may be cancelled or rescheduled without forfeiture at least 24 hours before its scheduled start. A later cancellation or no-show forfeits the applicable session or credit unless Cheri Cohen Pilates records an exception. A free phone consultation may be cancelled or rescheduled at least 12 hours before its start; a missed consultation may be rescheduled subject to availability and the applicable disclosed policy. Offer-specific expiration, transfer, refund, and business-cancellation terms shown and accepted at purchase also apply. We may change or cancel a service for safety, availability, instructor, location, technology, force-majeure, or operational reasons and will apply the accepted service terms and mandatory law.
Prices, payments, credits, and recurring offers
Prices, taxes, fees, deposits, installments, renewal cadence, package credits, expiration, and refund terms are those displayed for the exact offer before purchase. Stripe processes online payment credentials. By submitting a payment, you authorize the disclosed charge and represent that you may use the payment method. Cheri Cohen Pilates may correct obvious pricing or ledger errors, prevent fraud, and provide a record of a material correction.
A recurring membership or continuous service will not be created unless checkout clearly presents the price, monthly purchase-anniversary renewal cadence, included credits, rollover or expiration rule, commitment (if any), cancellation method, and pause rule and obtains affirmative consent. No default commitment, cancellation, or pause rule applies until it is stated in the exact published offer. An offer accepted online provides an online cancellation method as required by applicable law. Cancellation affects future renewals; current-term access, refunds, credits, and outstanding balances follow the accepted offer and mandatory law.
Digital content, education, and intellectual property
The site, branding, text, classes, curricula, videos, downloads, software, and other content are owned by Cheri Cohen Pilates or used with permission. Subject to payment, eligibility, and applicable offer terms, you receive a limited, personal, nonexclusive, nontransferable, revocable license to access content for its intended purpose during the stated access period.
- Do not copy, record, download except through an authorized feature, scrape, redistribute, sell, publicly perform, rebroadcast, share credentials, bypass access controls, or create derivative commercial materials without written permission.
- Do not upload malware, infringe another person's rights, impersonate someone, harass others, interfere with the platform, probe security, misuse payment or invitation flows, or use content or accounts for an unlawful purpose.
- Education admission, progress, completion, feedback, or a certificate does not promise employment, licensure, accreditation, earnings, client results, or acceptance by another organization unless the specific program expressly says otherwise.
Your submissions and communications
You retain ownership of material you submit. You grant Cheri Cohen Pilates a limited permission to host, process, reproduce, transmit, and display it only as needed to provide the requested feature, maintain records, secure the platform, and comply with law. Submit only material you have authority to provide. Do not send passwords, verification codes, payment-card information, illegal content, or detailed health information through ordinary messages or support.
Service email, account notices, receipts, security messages, and other communications reasonably related to a requested transaction or relationship may still be sent when permitted even if you decline marketing. Commercial email includes the required sender, postal, and unsubscribe information when applicable. Push notifications require separate browser permission and can be disabled on the device or in available preferences.
Text-message program
Cheri Cohen Pilates offers one optional choice for appointment and service texts and a separate optional choice for possible future studio-news and offer texts. Both choices start unchecked and messages may use automated technology. Marketing SMS is not being sent yet. Cheri Cohen Pilates may introduce occasional studio-news and offer texts in the future only for customers who make the separate optional marketing-SMS choice. That choice starts unchecked and can be changed independently. Saving this preference does not start marketing texts. Consent is not a condition of purchase, account creation, waitlist access, or service. Telnyx is the primary operational messaging provider. Twilio is the manually controlled secondary messaging provider and is not the current application messaging runtime.
Message frequency varies based on appointments and account activity; appointment messaging is generally up to four messages per appointment, and future marketing frequency will vary. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. Messages may include links to chericohenpilates.com. Do not send health, payment-card, password, or other sensitive information by text.
Reply STOP to opt out and HELP for help. After a prior valid opt-in and opt-out, reply START to request resubscription. You may also update available account preferences or clearly communicate a revocation request to hello@chericohenpilates.com. Opting out of texts does not prevent permitted non-SMS communications needed for a requested service.
The Privacy Policy explains mobile-data handling. The public Text Messaging Program describes the exact consent paths and message categories.
Third-party services and links
The platform depends on service providers for hosting, backend operations, authentication, video, communications, payments, and security. Their service terms may apply to the portion they operate. We are responsible for our selection and use of providers as required by law, but we do not control a third-party destination you independently choose to visit. Providers and integrations may change; a material privacy change will be handled under the Privacy Policy.
Availability, maintenance, and security
We may maintain, repair, update, suspend, limit, or discontinue a feature. We do not promise uninterrupted or error-free availability or delivery of a message, video, meeting, payment network, or third-party service. Do not attempt to bypass a capability, consent, eligibility, payment, or security control. We may preserve evidence, restrict access, or take other reasonable action to protect people, accounts, services, records, and systems.
Suspension and termination
We may suspend or terminate access for security risk, fraud, nonpayment, unlawful or harmful conduct, material breach, infringement, or misuse of services. We will apply accepted offer terms and mandatory law to existing appointments, purchases, balances, records, and access. Provisions that by their nature should survive—including payment obligations, intellectual property, records, disclaimers, and dispute-related provisions—continue after access ends.
Disclaimers and responsibility
To the extent permitted by law, the site and general content are provided on an as-available basis without a promise that every description, result, provider, link, or feature will always be complete, current, uninterrupted, or suitable for every person. You remain responsible for your decisions, device and connectivity, safe environment, accurate information, and compliance with applicable instructions and separately accepted agreements.
Nothing in these Terms excludes or limits a warranty, remedy, duty, or liability that applicable law does not permit us to exclude or limit. These Terms do not impose an arbitration agreement, jury waiver, or class-action waiver.
Changes and electronic records
We may update these Terms prospectively. The page will show the effective date, and we will provide additional notice or obtain renewed acceptance when required for a material change. Electronic acceptances, signatures, notices, and receipts may be used where permitted. You may save or print this page. Historical transactions and signatures remain attached to the exact version accepted for that event.
